Last updated: December 24, 2023
Introduction
Welcome to T.K. Sheth Law LLC (“TKSL”). By accessing, browsing, or using our website and its associated services (collectively, the "Platform"), you are entering into a binding agreement with T.K. Sheth Law LLC (TKSL, "we", "us", or "our"). Your use of the Platform signifies your unequivocal acceptance of these terms and conditions. If you disagree with any part of these terms, you must immediately cease all use of the Platform. We may, at our sole discretion, revise or update these terms periodically. Any changes will be effective upon posting the updated terms, as indicated by the "Last updated" date. Your continued use of the Platform after such updates constitutes your acceptance of the new terms. Users accessing the Platform from outside the United States are responsible for compliance with their local laws and regulations. If accessing or using our Platform would be contrary to or violate any applicable law in your jurisdiction, you are not authorized to view or use the Platform.
TKSL provides the information on this website as a convenience to its visitors. However, this website is not intended as, nor is it to be used as a substitute for, legal advice. TKSL makes no warranty or guarantee concerning the accuracy or reliability of the contents of this site or of websites to which it links. Eligibility
By accessing our platform, you confirm that you are at least 18 years old and possess the legal authority to enter into this agreement. Individuals below 18 years are strictly prohibited from using our services.
Service Offerings
TKSL is managed by Tanvi K. Sheth, an attorney licensed in the state of Illinois. We offer legal advice and representation in business transactions within interstate commerce, federal legal matters, and specific issues governed by Illinois state law. If your legal needs do not align with these areas, please refrain from signing up for our service.
This communication does not serve as an advertisement in non-Illinois jurisdictions. For state-specific matters outside Illinois, TKSL collaborates with qualified local co-counsel.
NO ESTABLISHED LEGAL RELATIONSHIP
While TKSL is operated by legal professionals, merely accessing our website, contacting us, communicating with us, purchasing subscription services, digital products, or consuming information associated with TKSL DOES NOT establish an attorney-client relationship. Such a relationship is only formed upon the signing of a formal engagement agreement by all parties.
By communicating with us any information pertaining to you, we do not offer any advice on whether you may have a legal remedy for your potential claim(s); TKSL does not make any representation or guarantee that you will obtain satisfaction, justice, or compensation for your potential claim(s); any conversation is not considered an opinion concerning the merits of any potential claim you might have. If both TKSL and you do not agree in advance and in writing to create an attorney-client relationship, none will exist.
Refund Policy for Subscription Products
Upon purchase of a subscription service, you immediately incur a monthly subscription fee based on your chosen level. This fee is considered earned at once, granting you instant access to our subscription benefits in compliance with relevant legal and professional standards. If you disagree with this immediate earning of fees, please refrain from subscribing. Unless a different fee agreement is made which would be documented in the formal engagement agreement, All fees paid to TKSL are recognized as earned upon payment. This ensures your access to exclusive subscriber benefits and services as outlined on our website. Any potential refunds provided don't change the earned status of these fees. Instead, they are returns of fees already deemed earned. Fees passed on to third parties are treated as operational costs borne by TKSL in delivering our services.
Service Adjustments
We may, at any moment, modify or terminate services, change the pricing, or suspend services without prior notice. You are responsible for staying updated with our website terms.
External Links
Our platform may contain links to third-party websites. TKSL is not responsible for the content, policies, or practices of these external sites.
Service/Order Limitations
TKSL may refuse, limit, or cancel any order or provision of service at our discretion. We may also restrict fulfillment of orders or service requests that seem to be placed by dealers, resellers, or distributors.
Feedback and Comments
If you send feedback, suggestions, or any other content, either at our request or voluntarily, you grant us the right to use, reproduce, modify, and publish such content without any obligation to compensate you.
Termination
TKSL reserves the right to terminate our engagement if mandated by professional conduct rules, if you provide inaccurate or misleading information, or if we determine that our working relationship is no longer tenable for any reason. Refunds on services terminated by TKSL are at TKSL’s discretion. TKSL will notify you if there is a problem processing your authorized automatic payment. Failure to update your payment method, if needed, may result in a cancellation of your subscription and disengagement.
Subscribing Entity
Subscriptions are designed for individual users or businesses. Document drafting, review, and/or negotiation must relate to the person, freelancer, or business for whom a subscription is purchased. Additional people or businesses must sign up for their own subscription.
Scheduled Meetings or Calls
Meetings or calls may be scheduled using the provided link once signed into the client portal. Available slots change based on other clients scheduling time and TKSL’s general availability.
Document Services
Document drafting and/or review requests will be processed in the order they are received. Typical though not guaranteed time to draft and/or review the document is two business days per 10 pages of documents submitted, accounting for weekends and holidays. TKSL may decline to draft and/or review documents if you submit them in excess volume or if TKSL believes you are submitting documents for review in a volume or manner that is not commercially reasonable.
Payment By Credit Card
If you are paying any amount to TKSL by credit card, debit card, or other electronic payment method, you authorize TKSL to charge your payment method for the indicated amount. If any service is charged on a recurring or automatic basis, you agree to allow TKSL to automatically charge your account on file.
Monthly Payment
You understand that subscription services are recurring and agree to allow TKSL to charge your card at renewal. Cancellations will take effect in the next billing cycle.
Subscription Payments
You agree and understand that the monthly subscription fee paid for your subscription level is an earned fixed fee immediately giving you the value of the subscription benefits upon payment. Except as otherwise provided, fees paid to TKSL are considered earned upon receipt as a minimum amount required to provide your subscription and access to subscription benefits.
Subscription Fee Increases
TKSL may increase subscription fees. Subscribers will be notified in advance of any changes.
Attorney-Client Relationship
An attorney-client relationship with TKSL is not automatically established by merely accessing or using this website. Such a relationship is only formed under the following conditions:
• Acceptance of this Engagement Agreement and Terms of Service
• Successful completion of the required payment
• Passing a conflicts check, and
• Completing any other steps as identified and directed by TKSL
All interactions, including the exchange of communications and documents via the client portal, are treated with the utmost confidentiality and are safeguarded by attorney-client privilege. To maintain this privilege, it is your responsibility to ensure that only you access the client portal using your unique login credentials.
For the preservation of attorney-client privilege, we strongly recommend exclusive communication through the client portal. If you choose to communicate outside of this portal, such as via email or text message, you bear the risk of potentially waiving the attorney-client privilege. The determination of such a waiver is subject to the discretion of a court of law and will be assessed on a case-by-case basis.
Conflicts of Interest
In adherence to the rules of professional conduct for attorneys, there are instances where representation is precluded due to a conflict of interest. TKSL may choose to decline or terminate your subscription service upon identifying such a conflict. If you've already made a payment, it will be considered as earned, accounting for the administrative costs associated with conducting the conflict check. However, should TKSL identify a conflict of interest that inhibits your engagement after payment has been made, the fees for that month's subscription will be refunded for the month the conflict was identified.
Indemnification
You agree to indemnify and hold harmless TKSL, its affiliates, partners, and employees from any claim or demand, including legal fees, arising from your use of our services or your breach of these Terms of Service. TKSL, its affiliates, and partners shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services or products.
Amendment
We reserve the right to modify these terms. Continued use of our services indicates agreement to any changes.
Notice
Official communication will be sent through the client portal or the email associated with your account. It's the subscriber's responsibility to maintain up-to-date contact information.
